Terms and Conditions

The owner of the online store spirimal.com (hereinafter the Online Store) is ASILA OÜ (registry code 14432140) located in Tartu, Ravila 49-25, Estonia 50408.

Validity of the sales contract


The terms of sale apply to the purchase of goods from the Online Store.
The prices of the products sold in the online store are indicated next to the products. A fee is added to the price for the delivery of the goods.
The delivery fee depends on the location of the buyer and the method of delivery.
The delivery fee will be shown to the buyer when ordering.
Information about the goods is provided in the Online Store directly next to the goods.

Orders

To order the goods, you must add the desired products to the shopping cart. You must fill in the required fields on order form and select the appropriate delivery method for the products. The amount of the fee will then be displayed on the screen, which can be paid securely through the following payment methods:

  • Bank links: Swedbank, SEB, LHV, Coop Pank, Citadele. NB! When paying with a bank link, be sure to click the “Back to Merchant” button on the bank’s page. Payments are mediated by Montonio Finance. Payment takes place outside the Online Store in a secure environment – when paying with a bank link in the secure environment of the respective bank. The seller does not have access to the customer’s bank and credit card details. The agreement enters into force upon receipt of the amount due to the current account of the Online Store. The owner of the online store is the chief processor of personal data and transmits the personal data necessary for making payments to the authorized processor Montonio Finance.
  • Direct bank transfer. Within seven days of receiving your order we will send you an invoice with notification via email. If the invoice is not paid within seven days, the order will be canceled. Payments will be accepted in euros.
    The agreement enters into force upon payment is received to the banking account of the Online Store.
    If the ordered goods cannot be delivered due to the expiration of the goods or for any other reason, the buyer will be notified as soon as possible and the money paid (incl. Delivery costs) will be refunded immediately, but not later than within 14 days of sending the notice.
    Your order will go directly to our partner company and it will be prepared after the order is completed, i.e. after the payment is received.
  • PayPal Payments: Check out simply and more securely at our online store with PayPal. The seller does not have access to the customer’s bank and credit card details. Shop with peace of mind, your eligible purchase is protected by PayPal. Read more

Goods and Prices

Warehouse products are made in Estonia and shipped out of Estonia.
Stock products will be sent within 1-3 working days.
Products on demand are made specifically for the customer within 3-7 working days from the entry into force of the sales contract by our partner who has factories all over the world.
The delivery fee is added to the price of the product.
The delivery fee depends on the location of the buyer and the method of delivery.
The delivery fee will be shown to the buyer when ordering.

Delivery

We work with an on-demand order fulfillment company with facilities worldwide!
Shipping costs are borne by the Online Store and the corresponding information is displayed next to the shipping method.
Usually, it takes 3–7 days to fulfill an order, after which it’s shipped out. The shipping time depends on your location, but can be estimated as follows:
● USA: 3–4 business days
● Europe: 6–8 business days
● Australia: 2–14 business days
● Japan: 4–8 business days
● International: 10–20 business days

We don’t ship to some countries because of legal restrictions or shipping carrier limitations. 
The list of restricted countries may change depending on world events, but for now, we don’t ship to the following destinations
● Crimea, Luhansk, and Donetsk regions in Ukraine
● Russia
● Belarus
● Ecuador
● Cuba
● Iran
● Syria
● North Korea

Our fulfillment times [for all products/t-shirts, mugs/etc.] may be longer than usual and may continue to increase until things get back to normal. We’re seeing delays in our supply chain, including distributors and shipping carriers as the entire industry is grappling with challenges. It’s difficult to predict the shipping times.
In exceptional cases, we have the right to deliver the goods within up to 45 calendar days.

Right of withdrawal

After placing the order, the buyer has the right  within 14 days to withdraw from the contract concluded in the online store.

The right of withdrawal does not apply if the buyer is a legal entity.

In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods in the manner permitted by the goods for testing in a physical store.

If the goods have been used for purposes other than those necessary for their nature, characteristics and or to show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.

In order to return the goods, a photo of the received order and application for withdrawal from the purchase of the goods must be submitted, the form of which can be found from here: Withdrawal application and send it to the email address within 14 days at the latest received receipt.

The cost of returning the goods shall be borne by the buyer, unless the reason for the return is the fact that the item to be returned does not correspond to what was ordered (eg a wrong or defective item).

The buyer must return the goods within 14 days of the application or provide proof that: she/he has handed over the goods to the carrier during that period.

The online store will return the payment of returned goods to the buyer immediately after receiving the goods, but not later than 14 days.

The online store may refuse to make refunds as long as the object of the contract is not returned or until the buyer has not provided evidence that she/he has returned the item, whichever takes place sooner.

If the buyer has explicitly chosen the cheapest delivery method offered by the online store other than the conventional delivery method, the Online Store does not have to return it to the consumer at a cost which exceeds the cost of the normal method of delivery.

The online store has the right to withdraw from the sale transaction and demand the return of the goods from the buyer if the price of the goods have been marked significantly below the market price of the goods due to a mistake.

Right to lodge a complaint

The online store is responsible for non-compliance or defect of the goods sold to the buyer, which already existed at the time the goods were handed over and which appears within two years of the goods transfer to the buyer. During the first six months from the date of delivery to the buyer, it is expected that the shortage already existed at the time of the transfer. The online store is rebutted by Obligation. The buyer has the right to contact the online store within two months at the latest by sending an e-mail to spirimals@gmail.com or by calling +37256231617.
The online store is not responsible for defects that have occurred after the delivery of the goods to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace defective goods. If the goods cannot be repaired or replaced, the Online Store will return all fees associated with the sales contract to the buyer.

The online store responds to a consumer complaint in writing within 15 days.

Direct marketing and processing of personal data

The online store uses the personal data entered by the buyer (incl. Name, telephone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer. The online store transmits personal data to transport companies for delivery
goods.

The online store will send the buyer newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to do so by entering the email address on the website and announcing it as your wish to receive direct mail notifications.

The buyer can unsubscribe from email offers and newsletters at any time
let us know by email or by following the instructions in the email containing the offers.

Solving disputes

If the buyer has any complaints regarding the Online Store, they must be sent to the e-mail address spirimals@gmail.com or call by phone: +37256231617.
If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer will be able to apply to the Consumer Disputes Committee. The procedural conditions and the application are available to submit here. The Consumer Disputes Committee is competent to resolve disputes arising out of the contract to the agreement between the buyer and the Online Store. The examination of the buyer’s complaint in the commission is free of charge. The buyer can turn to the European Union Consumer Dispute Resolution Platform.
